SMOKING

8.40. 010 Smoking defined. The following words and phrases, whenever used in this article, shall be construed as defined in this section: "Smoking" means inhaling, exhaling, burning or carrying any lighted cigar, cigarette, weed, plant or other combustible substance in any manner or in any form. 8.40. 020 Prohibition of smoking in public places. Smoking shall be prohibited in all city-owned buildings and property described below: A. All city-owned buildings including city hall, police headquarters, fire station, community center, city yard, Clark stadium building, the old South School Park buildings, Base III at 1035 Valley Drive, and any other such building/enclosed facility as the city may acquire, excepting therefrom, to the extent consistent with California Labor Code Section 6404.5(d), the atrium area of city hall and any other area exempted by minute action of the city council regardless of where said building/facility is specifically listed above; B. All city-owned vehicles. (Ord. 98-1175 § 1, 01-13-98; Ord. 94-1111 § 1, 1994: Ord. 93-1091 § 1, 1993: prior code § 141/2-5) C. The beach. The "beach" means that certain strip of land within the City laying between the westerly line of the Strand and the line of the ordinary tide of the Pacific Ocean. (Ord. 06-1267, §1, June, 2006)

8.40. 030 Posting of signs. "Smoking" or "No Smoking" signs, whichever are appropriate, with letters of not less than one inch in height or the international "No Smoking" symbol (consisting of a pictorial representation of a burning cigarette enclosed in a red circle with a red bar across it) shall be clearly, sufficiently and conspicuously posted in every building or other place where smoking is regulated by this article, by the owner, operator, manager or other person having control of such building or other place. 8.40. 040 Enforcement. A. Enforcement of this chapter shall be implemented by the director of public safety. B. Any citizen who desires to register a complaint under this article may initiate enforcement with the director of public safety. (Prior code § 141/2-7)

8.40. 050 Violations of smoking regulations. Violations of the provisions of this chapter are subject to the administrative penalty provisions of chapter 1.10. (Ord. 07-1281, Sept. 2007)

8.40. 060 Other applicable laws. This chapter shall not be interpreted or construed to permit smoking where it is otherwise restricted by other applicable laws. (Prior code § 141/2-9)
